1. Acceptance of Terms

Welcome to MoodMentor. By downloading, accessing, or using our mobile application and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and MoodMentor ("we," "us," or "our"). Please read them carefully.

2. Description of Service

MoodMentor is a mental wellness application that allows users to:

• Track daily mood on a 1-10 scale
• Log activities and factors affecting mood (tags)
• Write optional journal entries
• View mood trends and analytics
• Receive AI-powered insights and recommendations
• Export mood data as PDF or CSV reports

3. Not Medical Advice

Important: MoodMentor is designed for personal wellness tracking and self-awareness purposes only. The Service does not provide medical advice, diagnosis, or treatment.

• MoodMentor is not a substitute for professional medical care, mental health treatment, or therapy
• AI-generated insights are informational and should not be considered professional advice
• If you are experiencing a mental health crisis, please contact a healthcare professional or emergency services immediately
• Always consult with qualified healthcare providers about your mental health concerns

4. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
• Be at least 13 years of age (or the minimum age in your jurisdiction)

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

5. Subscriptions and Payments

5.1 Free and Premium Tiers

MoodMentor offers both free and premium subscription options. Premium features include unlimited history access, AI weekly insights, advanced analytics, and data export capabilities.

5.2 Billing

Premium subscriptions are billed through the Apple App Store or Google Play Store, depending on your device. By subscribing, you agree to their respective terms and payment policies.

5.3 Free Trial

We may offer a free trial period for Premium features. If you do not cancel before the trial ends, you will be automatically charged the subscription fee.

5.4 Cancellation

You may cancel your subscription at any time through the App Store or Google Play Store. Cancellation will take effect at the end of your current billing period. No refunds are provided for partial subscription periods.

5.5 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to your next billing cycle.

6. User Content

You retain ownership of all content you create within the Service, including mood entries, journal entries, and tags ("User Content"). By using the Service, you grant us a limited license to:

• Store and process your User Content to provide the Service
• Generate AI insights based on your mood data
• Create anonymized, aggregated statistics for service improvement

You agree not to submit User Content that is illegal, harmful, threatening, abusive, or otherwise objectionable.

7. Intellectual Property

The Service, including its design, features, content, and technology, is owned by MoodMentor and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the Service or its content
• Reverse engineer or attempt to extract the source code
• Use our trademarks, logos, or branding without permission
• Create derivative works based on the Service

8. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Transmit viruses, malware, or other harmful code
• Collect information about other users without consent
• Use the Service for any commercial purpose without authorization
• Impersonate any person or entity

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Merchantability and fitness for a particular purpose
• Accuracy or reliability of AI-generated insights
• Uninterrupted or error-free operation
• Security of data transmission

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOODMENTOR SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Any actions taken based on AI-generated insights or recommendations

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless MoodMentor, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination:

• Your right to use the Service will immediately cease
• You may request a copy of your data before deletion
• We may delete your account and all associated data
• Provisions that by their nature should survive will remain in effect

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware.

15. Dispute Resolution

Before filing a claim against MoodMentor, you agree to try to resolve the dispute informally by contacting us. If we cannot resolve the dispute within 30 days, either party may pursue formal legal action.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action or representative action.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MoodMentor regarding the Service and supersede all prior agreements and understandings.
